Council of Common Interests (CCI)

The CCI is the institutional face of cooperative federalism. It shifts the governance model from 'top-down' (Federal command) to 'horizontal' (shared decisions), where provinces are treated as partners in managing subjects like energy, water, and demographics.

Post-25th Amendment, the CCI's role became crucial in ensuring that the newly merged districts are properly accounted for in national data sets (Census) and that their resource needs are addressed in the collective federal-provincial framework.

While Parliament (the Center) has the power to legislate on subjects in FLL Part II, the Constitution mandates that the policy and supervision of these subjects must remain with the CCI. This prevents the federal executive from acting unilaterally on these matters.

The 7th (Digital) Census of Pakistan 2023 required formal approval from the CCI. This approval was a prerequisite for the Election Commission to start the delimitation of constituencies for the 2024 General Elections.

Prime Minister Shahbaz Sharif chaired the 50th meeting of the CCI in August 2023, which unanimously approved the results of the first-ever digital census, allowing the electoral process to move forward.

The Federal Government is responsible for laying the reports of the CCI before both Houses of Parliament. This ensures that the representatives of the people and the provinces are kept informed of the Council's activities and decisions.

Post and Telegraphs are listed in Part I of the Federal Legislative List, meaning they are under the exclusive control of the Federal Government. Electricity, Major Ports, and Legal/Medical professions (standards) are in Part II and thus under the CCI.

Because 'Mineral Oil and Natural Gas' are subjects in FLL Part II, any major policy regarding their exploration, pricing, or distribution (like the Petroleum Policy) must be vetted and approved by the CCI to protect provincial interests.

The Prime Minister is the constitutional Chairperson. While the Council can determine its own rules, the presence or delegation by the PM is essential as per the established structure, though the 18th amendment emphasizes the regularity of these meetings.

Sindh has frequently raised concerns in the CCI regarding the implementation of the 1991 Water Accord, specifically alleging that it does not receive its due share of water during shortages and questioning the telemetry system's accuracy.

The IPC Ministry (and its division) historically managed CCI affairs. However, after the 18th Amendment and subsequent demands for autonomy, a more independent and permanent CCI Secretariat was strengthened to handle the Council's increasing workload.

Since Railways and Electricity (DISCOs) are Part II subjects, any policy decision regarding their privatization must be brought to the CCI. Provinces often resist privatization if they feel it will lead to higher tariffs or job losses in their region.

Article 155 provides a protective mechanism where if a province feels a federal action (like building a dam or diverting a river) will harm its water interests, it can trigger a CCI investigation and decision-making process.

The NFC (Article 160) specifically deals with the distribution of financial resources from the divisible pool. The CCI (Article 153) handles policy, supervision, and dispute resolution regarding shared legislative subjects like energy, water, and census.

Industrial development, specifically where it is funded or managed by federal agencies but located in provinces, often falls under the coordination and policy oversight of the CCI to ensure balanced regional growth.

While the Constitution is silent on the specific quorum in the text of Article 153, the Council's own 'Rules of Business' generally require a majority representation from the provinces to ensure the decisions are seen as federating and legitimate.

Following the 18th Amendment, there was confusion over HEC's role. The CCI affirmed that while provinces can have their own commissions, the 'Standards in institutions for higher education' is a CCI subject (Part II), allowing the Federal HEC to maintain national quality standards.

Since Mineral Oil and Natural Gas are Part II subjects, OGRA—the body that regulates these sectors—falls under the policy oversight of the CCI.

Once the CCI makes a policy decision, it is the duty of the relevant federal ministries (like the Ministry of Energy or Railways) and the provincial departments to implement those decisions within their jurisdictions.

The 18th Amendment (2010) was the turning point. By abolishing the Concurrent List and moving vital subjects to FLL Part II, it forced the Center and Provinces to use the CCI as the primary engine for federal governance.
